These Terms and Conditions ("Terms") govern your access to and use of Dumebi, a personal finance artificial intelligence (AI) chatbot service accessible via WhatsApp and other platforms operated by [Your Company Legal Name] ("we", "us", or "our"). By using Dumebi, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. DEFINITIONS

For the purposes of these Terms:

1.1 "Account" means the unique profile created by a User to access the Service.
1.2 "AI Chatbot" refers to the Dumebi automated messaging system providing financial services and support.
1.3 "BVN" means Bank Verification Number as issued under the regulatory framework of the Central Bank of Nigeria (CBN).
1.4 "Service" means all features provided by Dumebi, including but not limited to money transfers, bill payments, budget tracking, financial tips, and customer support.
1.5 "User" means any individual who accesses or uses Dumebi.
1.6 "Wallet" means the virtual account linked to a User's profile for processing transactions.
1.7 "Third-party Provider" means any bank, payment processor, or service provider integrated into Dumebi.

2. ELIGIBILITY

2.1 You must be at least 18 years old (or 16 years old with parental/guardian consent) to use the Service.
2.2 You must have the legal capacity to enter into a binding contract under Nigerian law.
2.3 You must hold a valid Nigerian bank account and/or other means of payment acceptable to us.

3. ACCOUNT CREATION & VERIFICATION

3.1 To access Dumebi's financial services, you must complete the registration process via WhatsApp or other approved channels.
3.2 We may request personal information, including but not limited to your full name, phone number, BVN, government-issued identification, and proof of address.
3.3 You consent to Know Your Customer (KYC) verification in compliance with CBN regulations.
3.4 You are responsible for ensuring that the information you provide is accurate and up to date.

4. DESCRIPTION OF SERVICES

4.1 Dumebi provides, subject to availability and regulatory restrictions:
  • Money transfers (to bank accounts or other users)
  • Bill payments (airtime, data, utilities, subscriptions)
  • Budget tracking & expense analysis
  • AI-powered financial advice and tips
4.2 We may introduce, modify, or discontinue features at our discretion.

5. FEES & CHARGES

5.1 Fees for transactions will be disclosed prior to completion of each transaction.
5.2 We reserve the right to revise our fees with prior notice.
5.3 All fees are non-refundable unless stated otherwise.

6. USE OF THE SERVICE

6.1 You agree to use Dumebi only for lawful purposes and in accordance with applicable laws and regulations.
6.2 You must not:
  • Engage in fraud, money laundering, or terrorist financing.
  • Use the Service for any illegal or prohibited transactions.
  • Impersonate another person or misrepresent your identity.
6.3 We reserve the right to suspend or terminate your Account for suspicious or prohibited activity.

7. AI LIMITATIONS DISCLAIMER

7.1 The AI chatbot's financial tips are for informational purposes only and do not constitute licensed financial advice.
7.2 We do not guarantee the accuracy, completeness, or suitability of AI-generated information for your personal circumstances.

8. TRANSACTION PROCESSING

8.1 All transactions are processed through licensed third-party payment providers.
8.2 Transaction times may vary depending on banking and network conditions.
8.3 You are solely responsible for ensuring recipient details are correct before confirming a transaction.
8.4 Failed transactions will be reversed where applicable, subject to third-party processing timelines.

9. SECURITY & AUTHENTICATION

9.1 You are responsible for securing your device and any authentication credentials (e.g., PIN, OTP).
9.2 We are not liable for unauthorized transactions resulting from your negligence.
9.3 You must immediately notify us of any suspected unauthorized access to your Account.

10. USER RESPONSIBILITIES

You agree to:

  • Provide truthful and complete information.
  • Promptly update your account details if changes occur.
  • Comply with these Terms and applicable laws.

11. PROHIBITED USES

You may not use Dumebi to:

  • Conduct fraudulent, deceptive, or misleading activities.
  • Send or receive funds related to prohibited goods or services.
  • Harass, abuse, or threaten other users or our staff.
  • Distribute harmful, obscene, or unlawful content.

12. THIRD-PARTY SERVICES

12.1 Dumebi integrates with banks, payment processors, and service providers.
12.2 We are not responsible for the acts or omissions of third parties.

13. INTELLECTUAL PROPERTY

13.1 All rights, title, and interest in Dumebi, including but not limited to logos, trademarks, and software, remain our exclusive property.
13.2 You may not reproduce, modify, or distribute our intellectual property without prior written consent.

14. TERMINATION

14.1 You may close your Account at any time by contacting us.
14.2 We may suspend or terminate your Account without prior notice if you breach these Terms or applicable laws.

15. LIMITATION OF LIABILITY

15.1 To the maximum extent permitted by law, we shall not be liable for:
  • Indirect, incidental, or consequential damages.
  • Loss of profits, revenue, or data.
  • Delays or failures outside our reasonable control.
15.2 Our total liability shall not exceed the total fees paid by you in the three (3) months preceding the claim.

16. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims, losses, liabilities, or expenses arising from your use of Dumebi in violation of these Terms.

17. GOVERNING LAW & DISPUTE RESOLUTION

17.1 These Terms shall be governed by the laws of the Federal Republic of Nigeria.
17.2 Any dispute shall first be resolved amicably; failing that, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, Cap A18, Laws of the Federation of Nigeria 2004.

18. CHANGES TO THE TERMS

We may update these Terms from time to time. Updated versions will be posted with a revised "Last Updated" date. Your continued use of Dumebi constitutes acceptance of the updated Terms.
